These Terms & Conditions ("Terms") govern your access to and use of the websites, portals, telehealth platforms, and related products and services provided by Topp Health ("we," "us," "our"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.
You represent that you are at least 18 years old, have the legal capacity to enter into these Terms, and are located in a state where we currently offer Services. You agree to use the Services only for lawful purposes and in accordance with applicable laws.
You are responsible for maintaining the confidentiality of your credentials and for all activities under your account. You must enable multi-factor authentication when offered and notify us promptly of suspected unauthorized access. We may suspend or terminate accounts that pose security, legal, or clinical risk.
Content on our websites, emails, and marketing materials is for general informational and educational purposes only. It does NOT constitute medical advice and is NOT intended to diagnose, treat, cure, or prevent any disease or condition. Always seek the advice of a licensed physician or qualified healthcare provider regarding a medical condition.
If you use our telehealth services, our Telehealth Consent and Notice of Privacy Practices also apply. Clinical decisions are made by licensed professionals using independent clinical judgment. No particular outcome is guaranteed. We may determine that in-person care, lab work, or referral is necessary before or instead of treatment. Availability of Services depends on your state of residence and applicable licensing rules.
Fees for consultations, memberships, and products are disclosed at the time of purchase. Payment processing is handled by third-party processors. Refunds, cancellations, and subscription terms are as stated at checkout or in your membership agreement. Failure to pay may result in suspension of non-emergency Services.
By creating an account, you agree that we may contact you by email, phone, or SMS (where consented) about your account, appointments, care coordination, and service notices. You may update communication preferences or opt out of SMS as described in our Privacy Policy.
All content and materials available through the Services are owned by or licensed to Topp Health and protected by intellectual property laws. You may not copy, modify, distribute, or exploit any part of the Services except as expressly permitted in writing by us.

To the fullest extent permitted by law, Topp Health and its clinicians, contractors, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Services. Nothing in these Terms limits liability that cannot be limited under applicable law, including certain liability arising from professional negligence where such limitation is prohibited.
These Terms shall be governed by the laws of the State of Utah, without regard to conflict-of-law principles. Any legal action arising from these Terms shall be brought exclusively in the state or federal courts located in Salt Lake County, Utah, except where applicable law requires otherwise.
We may revise these Terms at any time. Your continued use of the Services after changes become effective constitutes acceptance of the updated Terms where permitted by law.
